1. Acceptance of terms
By subscribing to ARKKHE VPlayer (the "Service"), you (the "Customer") agree to these Terms of Service, the Privacy Policy, and the Cookie Policy. If you do not agree, do not use the Service.
These Terms form a binding electronic contract under applicable law.
2. About the service
ARKKHE VPlayer is a self-hosted video player and analytics platform for Video Sales Letters (VSLs), operated by ARKKHE Corp ("ARKKHE"). The Service includes:
- Embeddable web player for any landing page;
- Admin dashboard for video upload and configuration;
- Analytics including retention chart, play rate, and pitch retention;
- Conversion features (Turbo, ThumbSniper, Continue Watching, Smart Autoplay with A/B).
Video files are stored in the Customer's own Cloudflare R2 account. Metrics and configuration data live in the Customer's own Supabase database. ARKKHE does not retain copies of customer videos or data after termination.
3. Account & access
3.1. The account is provisioned automatically after payment confirmation. The Customer receives an email at the address used during purchase containing a temporary password and a link to the dashboard.
3.2. On first login, the dashboard requires the Customer to set a permanent password. The Customer is solely responsible for keeping credentials confidential and the email address up to date.
3.3. The Customer represents being at least 18 years old and having full legal capacity to contract. Entities must be represented by a duly authorized agent.
4. Payment & renewal
4.1. The subscription is billed on a recurring basis (monthly or yearly, at the cycle chosen by the Customer) by Stripe (Stripe, Inc., USA — PCI-DSS Level 1). ARKKHE never stores or has access to credit card data.
4.2. There is no free trial. Billing occurs at the time of purchase and access is granted immediately upon payment approval.
4.3. Renewal is automatic until canceled by the Customer.
4.4. If a charge fails, the Customer receives an email notification and Stripe attempts automatic retries over the following days. The Customer can update payment details at any time via Manage payment in /account. If the charge continues to fail, access is suspended until the next successful payment.
4.5. Pricing is shown in USD. Stripe Adaptive Pricing automatically displays the final amount in the Customer's local currency at checkout.
5. Cancellation & refunds
5.1. The Customer can cancel the subscription at any time directly in the dashboard, on the /account page. Cancellation is immediate and does not require contacting support.
5.2. Access remains active until the end of the period already paid.
5.3. Refund requests can be submitted by email to arkkhecorp@gmail.com. Approved refunds are processed within 2 business days.
5.4. After cancellation, the Customer's videos remain in their own Cloudflare R2 account and data remains in their own Supabase account. ARKKHE does not retain, copy, or delete those assets.
6. Acceptable use
The Customer agrees not to use the Service to:
- Host illegal, fraudulent, defamatory, libelous, racist, discriminatory, or rights-violating content;
- Distribute pornographic content involving minors or any material prohibited by applicable law;
- Engage in spam, phishing, malware distribution, or any activity that compromises network or system integrity;
- Reverse engineer, decompile, or circumvent the Service's security mechanisms;
- Resell or sublicense access without express written authorization.
ARKKHE may suspend or terminate accounts in violation of this clause without prior notice and without right to refund.
7. Intellectual property
7.1. The ARKKHE VPlayer software, its brand, logos, design, source code, documentation, and marketing materials are the exclusive property of ARKKHE Corp.
7.2. The Customer fully retains ownership of the videos and content hosted on their own infrastructure.
7.3. By using the Service, the Customer grants ARKKHE only the minimum license necessary to process and display the videos for the purpose of providing the Service.
8. Availability
8.1. ARKKHE strives to keep the Service available continuously but does not guarantee 100% uptime.
8.2. Scheduled maintenance will be communicated in advance whenever possible.
8.3. Outages of Cloudflare R2, Supabase, Stripe, Vercel, or other third-party providers outside ARKKHE's direct control do not constitute breach.
9. Limitation of liability
9.1. To the maximum extent permitted by law, ARKKHE shall not be liable for:
- Lost profits, indirect, moral, or consequential damages;
- Business decisions made by the Customer based on Service metrics;
- Data loss caused by Customer misconfiguration of their own infrastructure (R2, Supabase) or accidental deletion by the Customer.
9.2. ARKKHE's total liability in any case shall be limited to the amount actually paid by the Customer in the 12 (twelve) months preceding the event giving rise to the claim.
10. Privacy & personal data
The processing of personal data is governed by the Privacy Policy and, where applicable, the Data Processing Agreement (DPA), both of which are integral parts of these Terms.
11. Changes to terms
ARKKHE may update these Terms at any time. Material changes will be communicated by email at least 30 days in advance. Continued use after the effective date constitutes acceptance of the new terms.
12. Governing law & jurisdiction
These Terms are governed by applicable consumer protection laws. Disputes will be resolved at the Customer's domicile when the Customer is a consumer, or at ARKKHE's principal place of business otherwise, in accordance with applicable law.
